Jurisprudential fragmentation and the need to establish a unified interpretation: analysis of article 26.2 of Legislative Decree 029-2020 in crisis contexts
Abstract
This article analyzes the legal controversy arising from the interpretation of subsection b) of Article 26.2 of Emergency Decree No. 029-2020, a regulation issued during the state of health emergency caused by COVID-19. The central debate lies in determining whether this legal provision authorizes private sector companies to make unilateral deductions from labor benefits when employees have not compensated work hours, without the existence of an express agreement between the parties. Through the analysis of contradictory rulings issued by two Superior Courts and resolutions from the SUNAFIL Labor Inspection Tribunal, the article seeks to argue which interpretation of the decree is correct: whether an express agreement between employer and employee is required or whether automatic compensation followed by deductions from social benefits is permitted. Finally, it emphasizes the urgent need for the Supreme Court to issue a final ruling that unifies the interpretative criterion, in order to end the legal uncertainty that currently affects both employers and employees, ultimately advocating for the position that upholds the application of the fundamental labor principles enshrined in the Peruvian Constitution.
