La abstención de la victima-familia para rendir testimonio en el juzgamiento

Abstract

The importance of the victim's statement in the Peruvian criminal process is so important that it has been the subject of a pronouncement by the Supreme Court of Justice of Peru. The Plenary Agreement No. 2-2005/CJ-116, established that the victim's statement must pass through a filter - veracity indicators - to be considered valid proof of charge and sufficient to weaken the presumption of innocence of the accused. There is the Plenary Agreement No. 5-2016/CJ-116, it reiterates that the statement of the victim in crimes of violence against women and members of the family group must apply the veracity indicators, this has later been legalized in the regulation of Law No. 30364, Law to prevent, punish and eradicate violence against women and members of the family group - Supreme Decree No. 009-2016-MIMP, dated July 27, 2016. The right of abstention of the family witness of the accused is a legal precept and has constitutional roots, however, in many cases that family member called to the oral trial to testify is the victim herself. Then, it is worth asking if it is admissible if said witness-victim can refrain from testifying. The topic addressed contains a clear impression of procedural problems, however, there is a more delicate background, that is, the purpose of criminal law and criminal procedure. The reflections that were built were based on a judicial pragmatism which seeks to make the search for truth viable and, therefore, to approach justice.
