The environmental law of the enemy: a study of illegality and a new (and necessary) trend in environmental law
Abstract
Illegality continues to claim many victims, while damaging the environment and profiting on the black market, leaving anxiety anticipating the State. As such, they emerge as “enemies” of the rule of law, for which it must respond not only with more rule, but with intelligent and strategic actions that suppress the enemy and stop the illegal act. The “Environmental Law of the Enemy” is presented as a theory that solidly supports a prevention regime that implies having technology that incorporates resources in those who protect the environment and its components to avoid the realization of illegal activities. This study covers illegality, the thinking of communities, the definition of “enemy” and the justification for sustaining a new trend in environmental law.
