The local governments as holders of civil reparations in criminal proceedings for environmental crimes

Abstract

The duty to preserve and protect the environment is an obligation that transcends the three levels of government of the Peruvian State, that is, the central government, regional governments and local governments. The defense of the State in criminal proceedings for environmental crimes is exercised by the Specialized Attorney for Environmental Crimes, however it corresponds to local governments, district or provincial municipalities to receive the compensation that is set in these processes to be used to repair the damage caused for in the conservation of the environment of their constituency, because they are the government agencies that must assume all the social effects caused by environmental damage in sectors such as health, work and in the development of their municipality.
