The disciplinary dismissal of judges for not providing reasons for their judicial decisions
Abstract
This paper presents an investigation into Article 48, paragraph 13 of Law Nº. 29277, as enacted by the former National Council of the Magistracy (now the National Board of Justice), and whether it violates the constitutional principles enshrined in Article 139, paragraphs 1 and 2 of the Political Constitution of Peru, namely judicial independence and jurisdictional exclusivity.
This investigation stems from samples collected on the online platform of the former National Council of the Magistracy’s (now the National Board of Justice) official website. These samples were analyzed in light of the principle of judicial independence and under the doctrinal criteria gathered from Argentine and Ecuadorian research, where the same problem has arisen. In this sense, this investigation seeks to study how the disciplinary dismissal of judges for lack of justification in their judicial decisions is being carried out by the disciplinary administrative body (the former National Council of the Magistracy and now the National Board of Justice).
Upon completion of the investigation, it was concluded that, under its current wording, paragraph 13 of article 48 of Law Nº. 29277 – Judicial Career Law, does indeed violate the principles of judicial independence and exclusivity of the jurisdictional function; and requires urgent modification of its wording, since under the original text it causes the disciplinary administrative body to have a greater margin of discretion in its application and encroaches upon jurisdictional powers.
