La The primacy of human rights over the discourse of natural order: implications for the dignity of LGTBIQ+ persons
Abstract
This article aimed to analyze the primacy of human rights over the discourse of natural order and its implications for the dignity of the LGBTQ+ population. Regarding materials and methods, a basic qualitative research study was conducted using a hermeneutic method and a non-experimental documentary design. The research technique employed was documentary analysis of relevant academic, legal, and philosophical sources, selected through purposive sampling. The results demonstrated that human rights, based on the principles of equality, non-discrimination, and human dignity, are consolidated as a superior normative framework compared to traditional conceptions based on natural order. These traditional conceptions, in certain social contexts, implicitly justify discriminatory practices against the LGBTQ+ population. Furthermore, a gap was identified between the legal recognition of rights and their effective application in social reality, influenced by cultural patterns and deeply rooted beliefs. In conclusion, it was analyzed that the primacy of human rights is not only a legal principle, but also an ethical requirement that obliges us to critically question those practices and discourses that, under the guise of tradition or normality, violate human dignity; which demands the construction of a social order in which respect for diversity is not a concession, but an essential condition of justice.
