Digital justice and structural inequality: challenges for access to justice in the Peruvian judicial system
Abstract
The digitization of the judicial system in recent years has been promoted as a means to modernize the administration of justice and increase the efficiency of jurisdictional services. In Peru, the digitization of the judicial system has been implemented through tools such as the Electronic Judicial File, the Electronic Filing System, and virtual hearings, aimed at improving the management of the judicial process and the interaction between users and the justice system. However, the adoption of these tools has also entailed a series of significant challenges related to access to justice. This paper aims to examine how digital justice, the incorporation of digital technologies within the Peruvian judicial system, impacts access to justice, provided it is equitable with respect to existing structural inequalities. To this end, a qualitative approach is adopted, based on the documentary analysis of normative and doctrinal sources, as well as recent studies on digital transformation and the administration of justice. The results show, however, that while judicial digitization contributes to improved institutional efficiency, it can also create barriers for vulnerable populations due to persistent digital divides. Ultimately, the conclusion is that the digital transformation of the judicial system must be accompanied by public policies aimed at guaranteeing inclusion and equality in access to justice.
