Domestic abuse among migrant home-based and care workers in Spain
Abstract
This article analyzes Domestic violence against migrant women employed in the domestic and care sector in Spain from an intersectional perspective. Using Florencia Luna’s “layers of vulnerability” theory, it examines how gender, poverty, and irregular migratory status overlap to construct a situation of extreme defenselessness. The study highlights that the “live-in” work modality exacerbates this vulnerability by blurring the boundaries between work and private spaces, creating a “familiarization trap” that renders abuse invisible. Furthermore, it addresses the legal framework of these forms of violence under Section 173.2 of the Spanish Criminal code, debating the conceptual distinction between domestic and gender-based violence. It conclude that administrative irregularity and economic dependency act as critical barriers hindering access to justica, perpetuating the impunity of aggressors and nullifying the victims’ agency. The paper emphasizes the need for safe reporting protocols that prioritize human rights protection over migration control.
