Access to Justice for persons with disabilities and older adults: The Experience of the Good Practice Guides Prepared by the Supreme Court of Justice of the Province of Buenos Aires
Abstract
This paper addresses access to justice for persons with disabilities and older adults, based on two Good Practice Guides developed by the Supreme Court of Justice of the Province of Buenos Aires, Argentina. The focus of the Guides is aligned with the State’s obligations regarding equality and non-discrimination, and they promote effective actions to facilitate access to justice for persons with disabilities and older adults, who are more exposed to rights violations. The paper discusses, among other aspects, the meaning and scope of affirmative measures, reasonable accommodations, procedural and specific adjustments, appropriate attention, and clear and understandable communication. It also analyzes emblematic cases brought before the Inter-American Human Rights System and the United Nations human rights system. In all these cases, the actions of the domestic judicial systems where the violations occurred fell short of reinforced protection standards, and the victims were persons with disabilities and older adults.
