Access to Justice for Vulnerable Groups and its Impact on the Commission of Criminal Acts: Proposals for Improvement Through the Modernization of Public Administration
Abstract
The author presents a real case and analyzes the problem of poor access to justice for vulnerable victims, especially victims of sexual violence, highlighting limited access to public health programs and, consequently, secondary victimization, despite international commitments and the existence of Agenda 2030 and the Sustainable Development Goals (SDGs), a context that influences, in some cases, the commission of future crimes. Therefore, the author considers that, in order for criminal sanctions to be fair in particular cases, they require analysis from a gender perspective, given the victim's status as a gender-based violence. It is essential to analyze the circumstances prior to the criminal conduct, which in some cases influence the development of the victim's personality and influence the commission of the punishable act. It also formulates proposals for improvements, taking into account the concept of modernizing public management and implementing the philosophy of quality and the smart public management model, which will facilitate access to justice for all, especially for this vulnerable group. It also proposes legislative reform regarding the punitive treatment of women from a gender perspective, incorporating the text of Article 46-F of the Criminal Code as a privileged mitigating circumstance to gender-based violence as a context that preceded and influenced criminal conduct.
