Author Guidelines

1. Mission

To consolidate the knowledge of legal science and justice systems through the publication of quality research.

2. Article Sections

The Ipso Jure Review is composed of the following sections:

– Research articles

– Preliminaries

3. Characteristics for submitting articles and preliminaries

3.1. All papers submissions must meet the following requirements:

– Original.

– Unpublished.

– The contribution will only be required to apply for this review and not for another publication.

– Articles should have a main title in Spanish, English and Portuguese, plus an abstract/summary (300 words maximum) and a minimum of three key words, all in the three languages.

– Below the title, the author's name, the full name of the institution to which he/she belongs or with which he/she is institutionally identified (please disaggregate the acronym and indicate the city and country), his/her institutional e-mail address and his/her ORCID (Open Researcher and Contributor ID) code should be indicated.

– The manuscripts must be written in Times New Roman 12 with a 1,5 spacing, with the following margins: top and bottom 2.5 cm and left and right 2.5 cm, and it must have a minimum of 10 (5000 words) and a maximum of 30 pages (15 000 words).

– If the articles include graphs, photographs, figures or book covers, the images must have a resolution of 600 dpi and their respective caption.

– Foreign words or phrases must only be consigned in italicize letters, with no quotation marks, bold or underlining.

3.2. For preliminaries, the maximum length is four pages and they must have complete bibliographic data of the reviewed material (author, title, city, publisher, year and number of pages). In addition, the image of the cover of the book under review must be sent.

3.3. Authors are responsible for the manuscript and comments expressed in it, which do not necessarily share with the Board of Directors and the committees of the review.

3.4. Any contribution to the Ipso Jure review must be sent by clicking on the «Enviar artículo» tab [Submit a paper] on the website of the review, for continuous evaluation by anonymous peer review process.

3.5. The review process of the Ipso Jure Review takes two to three months, including the stages for the manuscript submission, peer review, and post-acceptance preparation for the publication. In the different editions of the Ipso Jure Review, the editor reserves the right to distribute the papers evaluated according to the requirements of each edition, which shall usually favor thematic criteria.

3.6. Authors must submit three declarations with the article: a) Metadata and Biodata Declaration; b) Originality Declaration; and c) Open Science Declaration.

3.7. In addition, authors should submit the text of their article using the manuscript submission template.

4. Rules for citing references in the body of the article

Papers submitted must meet the following reference standards according to the seventh edition of the Publication Manual of the American Psychological Association (APA, 2019).

4.1. Text of a single author

All quotes, either literal or paraphrased, must have a bibliographical reference at the end, which will guide the reader to learn the source of the quotation. This bibliographical reference shall be consigned at the end of the quotation, mentioning the author’s surname followed by the year of publication and the number of pages, each in both in brackets:

«Necesitamos repensar el modelo de un juez de vigilancia penitenciaria, porque esto no es un tema administrativo, la ejecución de los juzgados es parte de la potestad jurisdiccional y tenemos que ver modelos de roles» (San Martín, 2017, p. 38).

However, when the name of the author is mentioned prior to inserting the citation, the inclusion of his surnames in parentheses in the reference will no longer be necessary:

Propone el juez César San Martín (2017) que «Necesitamos repensar el modelo de un juez de vigilancia penitenciaria, porque esto no es un tema administrativo, la ejecución de los juzgados es parte de la potestad jurisdiccional y tenemos que ver modelos de roles» (p. 38).

If the cited author has more than one text in the final bibliography, the year of publication identifies the citation. The reference is identified in small letters (a, b, etc.), when the name of the author and the year coincide:

«Según el inciso 1 del artículo 28 de la Constitución Política del Perú, el Estado garantiza el derecho a la libertad sindical. Esta garantía se manifiesta no solo en la protección de los dirigentes frente a los actos antisindicales, sino también en el reconocimiento de ciertas prerrogativas para que dichos dirigentes puedan ejercer de modo eficaz su actividad de representación, así como en facilidades para el funcionamiento de la organización sindical. Entre estas facilidades están la licencia o permiso sindical y la cuota sindical» (Arévalo, 2019a, p. 94).

«En el derecho romano se distinguió entre el arrendamiento de cosas y el arrendamiento de servicios. Por el contrato de arrendamiento de cosas (locatio conductio rei) el locador se comprometía a otorgar al conductor el disfrute temporal de una cosa mueble (se incluía a los animales y a los esclavos) o inmueble, a cambio de lo cual percibía un ingreso de dinero llamado merces» (Arévalo, 2019b, p. 23).

4.2. Text citation with two authors

The cited text will be separated by the conjunction «and», when it has two authors.

«Asimismo, para que este proceso civil oral sea viable, resulta imprescindible que se cambie o varíe la organización de los despachos judiciales del modelo tradicional que existe hasta la fecha. En efecto, organizacionalmente, en este tipo de procesos orales, como se tiene dicho, el hito central ya no es el expediente, sino la audiencia; por lo tanto, los recursos del Juzgado deben estar colocados en función de la más eficaz y eficiente organización de la audiencia» (Bustamante y Angulo, 2020, p. 34).

4.3. Text citation with multiple authors

If the cited text has three, four or five authors, put the surname of all the authors the first time the reference appears. In subsequent citations include the surname of the first author followed by the abbreviation et al. (without italics and with a full stop after al):

«Hasta hace no mucho tiempo, una de las preguntas fundamentales sobre el derecho internacional público era si efectivamente era un derecho y si podía ser objeto de investigación científica. Por ejemplo, y por nombrar solo dos obras clásicas de la filosofía del derecho, Kelsen (2017 [1960], pp. 554-558) abre precisamente con esa pregunta su capítulo VII sobre Estado y derecho internacional de la Teoría pura del derecho (segunda edición) y así también comienza Hart (1994, pp. 212-216) el capítulo X sobre el derecho internacional en El concepto del derecho» (Lucas, Tijmes, Salassa y Sommer, 2019, p. 388).

«Tener clara la existencia del derecho internacional ha facilitado (y probablemente ha incentivado) dirigir la mirada desde el núcleo de la disciplina hacia sus fronteras y límites. Tenemos claro que sí es derecho y tal vez por eso nos estamos preguntando si esa respuesta no será demasiado categórica. El derecho internacional público es derecho, ¿pero es solo derecho? ¿Es un fenómeno exclusivamente jurídico? Y a partir de las preguntas anteriores: ¿cuáles son las fronteras metodológicas para la investigación sobre el derecho internacional?» (Lucas et al., 2019, p. 389).

4.4. Text citation of an institutional author

If the cited text does not include the author’s name, it will be registered the institution’s name or entity responsible for the publication.

En el caso de los nombramientos judiciales de primera y segunda instancia estos eran «ratificados por la Corte Suprema cada cinco años» (Congreso de la República, 1929, artículos 148 y 152).

«Si bien los plenos jurisdiccionales superiores se inician en la década de 1990, será a partir del presente siglo, que tendrán regularidad y vocación de permanencia en la práctica. Por primera vez se han organizado plenos exclusivamente en materia contencioso administrativa, comercial y abuso y explotación sexual comercial de niños, niñas y adolescentes» (Poder Judicial, 2012, p. 19).

«Declaran Patrimonio Cultural de la Nación al manuscrito autógrafo “Rusia ante el Segundo Plan Quinquenal (1932-1933)”, del escritor peruano César Abraham Vallejo Mendoza» (El Peruano, 2019, p. 17).

4.5. How to insert citations

If the literal citation is less than five lines long, it will be indicated with quotation marks and it will be incorporated as part of the text.

El Presidente del Poder Judicial, en su Mensaje al Perú, anunció que «está en marcha un proyecto para área verde en la azotea de este Palacio de Justicia que antes era depósito de chatarra, así como la instalación del primer Panel Solar en el Poder Judicial» (Rodríguez, 2017, p. 26).

If the literal quote exceeds five lines in length, it should be without quotation marks and in a separate paragraph, indented to the left, with line spacing and minor typography (Times New Roman 10).

El Presidente del Poder Judicial, en su Mensaje al Perú, anunció que:

está en marcha un proyecto para área verde en la azotea de este Palacio de Justicia que antes era depósito de chatarra, así como la instalación del primer Panel Solar en el Poder Judicial, que permitirá con energía limpia iluminar por lo menos la Presidencia de la Corte Suprema, siendo al mismo tiempo un mensaje a los jueces del Perú para que asuman la defensa del medio ambiente como bien jurídico y la salud de nuestro gran hogar que es el planeta Tierra (Rodríguez, 2017, pp. 26-29).

It is not necessary to use the ellipsis […] neither at the beginning nor at the end of the literal citation unless, in order to prevent a misinterpretation, it is required to emphasize that the quotation begins or begins in the middle of the sentence.

4.6. Quotations of online material without paging

All quotations from online texts must have a reference at the end, which is the information that will serve to know the source from which the quotation has been taken. This reference will be indicated at the end of the quotation, noting in brackets the author’s last name, followed by the year of publication and the paragraph number, using the abbreviation (párr.), as many electronic sources do not provide page numbers:

«La obra que está haciendo el Poder Judicial del Perú sobre las Reglas de Brasilia merece algo más que un reconocimiento simbólico, porque sus avances en materia de implementación y concienciación de estas reglas lo sitúan en primera línea, a la vanguardia, siendo un referente para todos los países iberoamericanos» (Martínez, 2020, párr. 3).

In cases where the online text has many paragraphs, the subtitle of the text can be included in parentheses, in order to direct the reader to the location of the quoted text more precisely:

«Que el Poder Judicial se legitime socialmente y que para ello se transformen sus estructuras es algo que el país exige y espera con ansias, casi como si buscara un reformador que clave en las puertas de Palacio 95 tesis que expresen su furia y desazón, pero también su esperanza en el imprescindible cambio» (Calderón, 2020, «El necesario cambio», párr. 4).

4.7. Paraphrasing or summarizing

If the citation is not literal and the general idea is paraphrased or summarized, it is recommended to indicate the page or paragraph number, as this information will help a reader interested in locating the relevant fragment of a long text.

Example of a literal quotation:

El presidente del Poder Judicial, en su Mensaje al Perú, anunció que «está en marcha un proyecto para área verde en la azotea de este Palacio de Justicia que antes era depósito de chatarra, así como la instalación del primer Panel Solar en el Poder Judicial» (Rodríguez, 2017, p. 26).

Example of paraphrasing:

El presidente del Poder Judicial, en su Mensaje al Perú, afirmó que en el Palacio de Justicia se implementará el primer panel solar (Rodríguez, 2017, p. 26).

5. List of final references

At the end of the article, only the references cited in the text should be included and it will be organized alphabetically. If you cited two or more works by the same author, it should be ordered by age, starting with the oldest work. And if two or more works by the same author published in the same year are cited, they should be distinguished with the letters a, b, c, etc., after the year of publication:
